He must lead by example if he is our leader. A forcing move is necessary now. Him standing up and saying he will not be silenced by a political prosecution would inspire tens of millions to refuse to be silenced. Maybe hundreds of millions across the globe. If he is to be martyred then let them martyr him over free speech. Our First Amendment. If he obeys a gag order he will be communicating he is willing to sacrifice our most important guarantor of our precious freedom. He is not above the law. But he's not below it, either.
